THE ADMINISTRATIVE COURT OF THE STATE OF MEXICO RECOGNIZES THE LEGITIMATE INTEREST OF NEIGHBORS TO CHALLENGE THE PERMITS TO BUILD AN APARTMENT COMPLEX

The Second Section of the Superior Chamber of the Administrative Court of the State of Mexico ruled that a neighbor of La Herradura in the city of Huixquilucan, has a legitimate interest in challenging the legality of licenses for land use and construction, issued to a third party to build an apartment complex in an area for low density residences. This stems from a November 30, 2012 ruling, sponsored by Rusconi & Sauza. This ruling reverses the determination made by a lower court in which, wrongly, the Regional Chamber found that a neighbor could not challenge acts that were not issued on his behalf. With this, the criterion that gives legal standing to the neighbors, to challenge in court the proliferation of illegal constructions, is strengthened.
