HEAD OF GOVERNMENT AND SECRETARY OF FINANCE OF CDMX REFUSE TO PROVIDE INFORMATION TO A DISTRICT JUDGE ON HOW THE RECONSTRUCTION FUND HAS BEEN SPENT

On April 4, 2018, the Eighth District Court in Administrative Matters in Mexico City admitted an amparo, sponsored by Rusconi Lawyers, against the Head of Government and the Secretary of Finance of Mexico City, due to their failure to issue the rules that would enable the Reconstruction Fund of Mexico City, totaling $5 billion pesos, to be used for the benefit of the victims of the earthquake.

When admitting the amparo lawsuit, the District Judge granted a suspension of the claimed act with positive effects, consisting of the obligation for the responsible authorities to immediately provide the judge with information on how the reconstruction fund has been spent to date. However, far from complying with the judicial order, the Head of Government and the Secretary of Finance, as of May 31, 2018, have refrained from providing any information regarding the way the funds have been used. Therefore, by a resolution issued on May 17, 2018, the Eighth District Judge in Administrative Matters warned the Head of Government and the Secretary of Finance with imposing a fine equivalent to one hundred times the current minimum wage in Mexico City, each, in case they do not report completely and immediately how the money for reconstruction has been spent.
