RUSCONI & SAUZA WINS INDIRECT AMPARO REQUIRING MEXICO CITY GOVERNMENT TO ISSUE URBAN ORCHARDS LAW REGULATION

In August 2022, Rusconi & Sauza filed an indirect amparo against the Head of Government and the Secretary of the Environment of Mexico City. This action was in response to the non-compliance with a mandate established in the Urban Orchards Law of Mexico City, published on December 31, 2020, in the Official Gazette. The law required the relevant authorities to draft and issue, within a period not exceeding 180 calendar days, the regulations and technical guidelines for the care and management of urban orchards, including the selection of species and urban agriculture practices. These guidelines were crucial for the effective implementation of the law but had not been published by the date the amparo was filed.

The resolution of this case came on December 21, 2022, when Rusconi & Sauza won the indirect amparo. This decision was confirmed on April 19, 2023, after a review. As a result of this judicial resolution, on April 14, 2023, the "DECREE ISSUING THE REGULATION OF THE URBAN ORCHARDS LAW OF MEXICO CITY" was finally published in the Official Gazette of Mexico City. This publication marked a significant advancement for the execution of the Urban Orchards Law, allowing its practical application and promoting urban agriculture in the city.
